Current data protection regulations establish that, taking into account the state of the art, the costs of implementation, and the nature, scope, context and purposes of the processing, as well as risks of varying likelihood and severity to the rights and freedoms of natural persons, appropriate technical and organizational measures shall be implemented to ensure a level of security appropriate to the risk, including, where applicable, among others: (i) pseudonymization and encryption of personal data; (ii) the ability to ensure the continued confidentiality, integrity, availability and resilience of processing systems and services; (iii) the ability to restore availability and access to personal data promptly in the event of a physical or technical incident; (iv) a process for regular verification, evaluation and assessment of the effectiveness of the technical and organizational measures to ensure the security of the processing.
When transmitting data over the Internet, it must be ensured that the data is encrypted or encoded to prevent access by third parties. In this regard, EMBRYA has put in place all the measures that the available technology allows because at EMBRYA we take your security and privacy very seriously.
This statement sets forth our privacy policy with respect to the information you provide to us by accepting these terms and conditions. The user, by accepting the general conditions, expressly consents, through such affirmative action, to the incorporation of their personal contact data in our systems and for the following purposes that the user also expressly accepts:
Responsible for the treatment
The data controller is EMBRYA M2B, S.L. with NIF B23977408, registered office at C/Balmes, 238 (08006), Barcelona (hereinafter “EMBRYA”).
Purpose of treatment
The collection and use of personal data, with the exception of the cases described in the following section “data processing to enable web access”, is only possible if you voluntarily provide us with your personal data. This applies for the following situations and purposes:
Medical Treatment (“the Treatment”)
The personal data provided in the course of your request for processing (the “Request”) will be collected, processed and used by EMBRYA in order to manage your request for the subsequent execution of the Contract signed, and for the purpose of maintaining the contractual relationship, management, administration, provision, expansion and improvement of services, as well as the sending of technical and operational information related to the Processing, by any means, including email and/or equivalent means. In this sense, we inform you that your personal data together with the result of possible satisfaction surveys will be used to evaluate your opinion and study your particular profile, with the sole purpose of improving the services provided by us and thus adapt and design our commercial offers.
In the case of collecting health data, the purpose will be to be able to provide the medical services that, in accordance with your express request, are most effectively tailored to your personal and health circumstances. No health data will be disclosed to third parties, except for legal obligation or the pursuit of a legitimate interest of the company, a third party or yourself or as part of the chosen Treatment. In relation to your health data, in the event that they are not provided, EMBRYA reserves the right to refuse the corresponding service.
At the time of the Application, the personal data of other members may also be uploaded. We therefore ask you to ensure that this information is provided with the consent of those accompanying you.
Transfer of your data
We inform you that EMBRYA will communicate your personal data to the different suppliers of the products and services that are necessary for the execution of the Processing object of contracting, who will be obliged to use the data, solely and exclusively, to comply with the object of the same and all this, under the contracts concluded with third parties previously.
Retention period of contracting data
Personal data provided during Processing will be kept by EMBRYA for as long as the business relationship between the parties is maintained and for a maximum period of; i) in the case of patients, for at least 15 years from the date of discharge from each healthcare process; and ii) in the case of donors, 30 years after the clinical use or expiration of the cells obtained.
Legitimacy of the treatment
The legal basis for the processing of your personal data is, in relation to the aforementioned purposes, the execution of the requested processing (Law 14/1986, of April 25, 1986, General Health).
Additional purposes to the Processing
For any other processing other than that mentioned in the previous paragraph, EMBRYA will, at all times, require your express and unequivocal consent. Thus, for when the further processing of personal data for a purpose other than that for which they were collected is planned, information on such other purpose and any additional relevant information will be provided prior to such further processing, so that the user can express his express and unequivocal consent.
Purposes of processing to enable the use of the website
When you visit any of our websites, we collect the data necessary for you to access them (usage data). This includes your IP address and data on the start, end and subject of your use of the website, as well as possibly identification data (e.g. your login data if you register in the Private area). This data is used for the provision and design of the service based on the needs of the individual user and is deleted as soon as it is no longer needed.
- Usage profiles with pseudonyms for advertising and market research (web tracking and analysis)
For advertising, market research and to make the use of our websites as pleasant as possible, EMBRYA uses web tracking systems. In this regard, data on the use of our website in pseudonymous user profiles are stored. This will allow us to further develop our websites and tailor our content to your needs. In addition, the usage profiles are used for so-called redirection. This allows EMBRYA to publish and insert interesting offers on other websites you visit. Pseudonymous usage profiles are not combined with personal data.
You can object to the creation of pseudonymous usage profiles. On the one hand, you can prevent the setting of cookies in your browser (see Cookie Policy). On the other hand, you can install certain browser plug-ins to protect your privacy, which make tracking impossible. - Data collection by third-party providers / social networks
Our website contains links to operators of social networks (e.g. Facebook, XING, Google My Business, LinkedIn, X, etc.). These social networks are operated exclusively by third parties. No data will be transferred to third parties unless you have previously given your express and unequivocal consent, or by legal obligation or decision or the pursuit of a legitimate interest of the company, a third party or yourself. However, your data may be communicated to other entities of the business group to which EMBRYA belongs for the proper execution of the purposes described in the section Purpose of the collection, processing and use of personal data of this policy.
Exercise of rights
We inform you that you have the right, free of charge and to the extent that legal requirements are met, to obtain confirmation as to whether or not EMBRYA processes personal data concerning you. As a data subject, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected. You may also request the limitation of the processing of your data, in which case we will only keep them for the exercise or defense of claims or for compelling legitimate reasons as well as, in certain cases, the portability of your data.
In certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. EMBRYA will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.
You may exercise your right to object to all communications for the purpose of sending advertising. Insofar as you have given your data protection consent, you may revoke it at any time with effect for the future.
To exercise these rights, you may write to EMBRYA with the reference “Derechos RGPD”, to EMBRYA, dpto. de Atención al Paciente C/ Balmes, 238 – 08006 (Barcelona) or by e-mail to EMBRYA’s DPO (dpo@eugin.es) attaching a copy of an official identification document or by e-mail addressed to EMBRYA.
Complaints before the data protection authority
The user can address their claims arising from the processing of their personal data to the Spanish Data Protection Agency (www.aepd.es).
Commercial Communications Policy
EMBRYA is committed to protecting the personal information you share with us. This statement sets forth our privacy policy with respect to the information you provide to us by accepting these conditions for sending communications. By accepting these terms and conditions, you expressly consent, through this affirmative action, to the incorporation of your personal contact information in our systems and its use for the following purposes:
- Sending of commercial communications. Send commercial communications both on paper and by electronic or telematic means and direct contact regarding the services marketed by EMBRYA from time to time.
- Other commercial shipments. EMBRYA may process the personal data you have provided (such as contact details and personal details, such as date of birth or hobbies) for the purpose of sending selected information about its services, for market research or for other regular marketing communications (such as announcements of events and/or trade fairs).

The user may access his/her information, rectify it, request its cancellation or oppose its processing, as well as withdraw consent at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal, by writing to dpo@blivfclinic.com.
- Claims before the data protection authority. The user can address their claims arising from the processing of their personal data to the Spanish Data Protection Agency (www.aepd.es).
General conditions of use of this website
EMBRYA, the owner of this website, only obtains and keeps the following information about visitors to our website:
- The IP address that gives them access to the network. This allows us to compile statistics on the countries and servers that visit our website most often.
- The date and time of access to our website. This allows us to find out the busiest hours, and make the necessary adjustments to avoid saturation problems during our peak hours.
- The number of pages viewed and the time each page has been open, as well as the entry and exit pages to the site and the click path taken. With this data, information priorities can be established for Internet users and the most successful areas can be identified in order to improve your content, so that users can obtain a more satisfactory result.

The information obtained is completely anonymous, and in no case can it be associated to a specific and identified user.
